1. ACKNOWLEDGMENT AND ACCEPTANCE OF TERMS OF USE
Your use of Earthgrid Sites indicates your agreement to the Earthgrid Sites Terms of Use laid out below and acknowledgment of the Earthgrid Sites Legal Statements. These documents may be modified without prior notice provided that the terms regarding the introduction of paid services are not altered without timely notification of all users. User's continued use of the service constitutes an affirmative acknowledgment by user of these modifications.

2. DESCRIPTION OF SERVICE. MODIFICATIONS TO SERVICE
Earthgrid Sites provides users with various web publishing and content management services, including but not limited to the ability to create and maintain a web page as well as the hosting services for this webpage. In order to use the service users should provide for own access to internet and pay any service fees associated with such access.Earthgrid Sites reserves the right to change the terms of service and prices for paid upgrades without prior notification. Earthgrid Sites reserves the right to delete unpaid accounts, which have not been paid for at most 60 days of time, following an email notification and the expiration of the warning period defined therein. 3. USERS OBLIGATIONS AND CONDUCT
Each user bears the sole responsibility for the content published on their Earthgrid Sites account / plan website. Earthgrid Sites does not control the content posted via the service under the client managed plans / sws managed plans and, as such, does not guarantee the accuracy or quality of such content and cannot be held responsible for it. Earthgrid Sites will only make changes to a users website on their written consent via email or via mail. Any changes made to the client's website at their request would AT ALL TIMES have to adhere to the Terms of Use and Legal Statements. Use of the service is subject to all applicable local, state, national and international laws and regulations as well as to internet-specific policies and procedures.
User agrees:
(i) not to use the service for illegal purposes;
(ii) not to publish any material that is unlawful, harassing, abusive, threatening, offensive, vulgar, obscene, harmful, libelous, invasive of another's privacy or constitutes an infringement of third party intellectual property rights.
(iii) not to interfere with or disrupt in any way the service including servers and networks connected to the service;
(iv) not to interfere with another user's enjoyment of the service.
User should indemnify and hold Earthgrid Sites and its subsidiaries, affiliates, officers and employees, harmless from any claim or demand made by any third party due to or arising out of user's conduct, violation of these Terms of Use by user, or the infringement by user of any intellectual property or other right of any person or entity. Earthgrid Sites may, at its sole discretion, terminate the service should a user's conduct fail to conform to these terms and conditions.
4. USER ACCOUNTS AND SECURITY
Users are entirely responsible if they do not maintain the confidentiality of their password and account, as well as of password protected areas of their sites. Users are entirely responsible for any and all activities which occur under their account. Users agree to immediately notify Earthgrid Sites of any unauthorized use of their account or any other breach of security known to user.
5. CONTENT OWNERSHIP
Users retain copyright ownership and all related rights for materials published on their Earthgrid Sites website.
6. STORAGE AND OTHER LIMITATIONS
Earthgrid Sites reserves the right to automatically clean assets exceeding the storage limit, after sending an email notification for exceeding the limit and failure on the part of the user to take subsequent action to clean the surplus assets or alternatively request an upgrade of the account. Earthgrid Sites assumes no responsibility for the deletion or failure to store information entered into Earthgrid Sites.
7. NOTICE AND TERMINATION OF SERVICE
Either Earthgrid Sites or the user may terminate use of the Service with or without cause at any time and effective immediately, if the user is not on a contract with Earthgrid Sites.
Earthgrid Sites shall not be liable to users or any third party for termination of the service. Upon termination, user's right to use the service and the related software ceases immediately. Earthgrid Sites may publish notices on this website (earthgrid.com) to inform users of changes to the service, Terms of Use, or other important procedures; such postings shall constitute notice to users.
In creating a website with Earthgrid Sites, you are liable to pay for all hosting charges until an account is deleted, regardless of whether you are actively using our hosting service or not on your primary domain name. Due to an increased volume of email and 'phishing' we DO NOT cancel accounts or delete websites via email due to the implications that could cause for customers. If you wish to delete your website, you need to Log In to your website and go to the My Account>Cancel Account. An email will be sent by the system to the account on file to the account holder. Once your account is deleted, it cannot be recovered.
8. REFUND POLICY
Products purchased from
PayMyGrid.com (our billing system) may be refunded only if cancelled within the following time frame: - Annual Plans - Within 30 days of the date of the transaction
- Monthly Plans* - Within 48 hours of the date of the transaction.
*Monthly Plans include all plans with less than a 1-year term (e.g., 6 months etc.)
“Date of the transaction,” for the purpose of this Refund Policy, means the date of purchase of any product or service, which includes the date any renewal is processed by PayMyGrid.com in accordance with the terms and conditions of the applicable product or service agreement. You may cancel a product at any time, but a refund will only be issued if cancellation is requested within the refund time frame specified for the applicable product, if available at all.
9. COMMUNICATIONS POLICY
If you are unable to access your account, cancel your service, or have any questions please contact us via our Priority Contact Form or via telephone toll free 1-800-557-0212 ; International/FAX (650) 980-5011. Any email communications must be through this form to validate their authenticity. Other emails may be ignored and do not constitute a valid means of communication. Email is not an offer capable of acceptance, does not evidence an intention to enter into an agreement, has no operative effect until a definitive agreement is signed in writing by both parties via facsimile or certified e-documents. No party should act in reliance on the email or any representations of the sender until a definitive agreement is signed in writing.
